Welcome to HeimMax. These terms apply to your use of our website and our general engagement with you. If you engage HeimMax to deliver work, you’ll receive a separate proposal and engagement letter outlining the specific scope, deliverables, fees, timelines, and obligations for that project.

Who we are

HeimMax Pty Ltd (ABN 39 695 981 161) is an Australian Pty Ltd company based in Melbourne, Australia. We build bespoke software, AI agents, websites, and marketing systems for small and medium businesses.

Using our website

You can use heimmax.com to learn about our services, book a discovery call, and get in touch. By using the site you agree:

  • Not to misuse or interfere with the site
  • Not to copy, reproduce, or republish content without permission
  • That information on the site is general in nature and not a substitute for advice tailored to your specific business

Discovery calls and proposals

Discovery calls are free and come with no obligation. If we proceed to a proposal, the proposal will set out the scope, fixed price, timeline, and ownership terms for the work. The proposal becomes binding once both parties sign or accept it.

Our work and your ownership

Where we build software, agents, or systems for you, you own the resulting work outright once it has been paid for in full. We don’t charge ongoing licence fees or retain rights to your business data. Where we use third-party tools or libraries to deliver the work, those tools remain subject to their own licences, and we’ll note these clearly in your proposal.

Payment

Payment terms are set out in each individual proposal. As a general rule, we work on fixed-price engagements with milestone-based payments. Invoices are due within 30 days of issue. Late payments may incur reasonable interest at our discretion.

Confidentiality

We treat information about your business as confidential. We won’t share it with third parties without your permission, except where required by law or as needed to deliver the work (e.g. with subcontractors who are themselves bound by confidentiality).

Warranties and liability

We work professionally and to a high standard. Where we deliver software or systems, we offer a 30-day period during which we’ll fix any defects in the delivered work at no charge.

To the extent permitted by law, our total liability to you under any engagement is limited to the fees you have paid us for that engagement. We are not liable for indirect, consequential, or business-loss damages.

Nothing in these terms limits or excludes your rights under the Australian Consumer Law.

Cancellation

Either party can cancel a project for material breach (e.g. non-payment, failure to deliver). Cancellation terms for individual projects are set out in each proposal. In general, you pay for work completed up to the point of cancellation.

Changes to these terms

We may update these terms from time to time. The latest version will always be at heimmax.com/terms.
